Assembly approves prevailing wage requirement for construction projects awarded state tax credits


STATE HOUSE – The General Assembly today approved legislation sponsored by Rep. Brandon Potter and Sen. Meghan E. Kallman requiring construction projects worth more than $10 million that receive state tax credits through the Rebuild RI or historic preservation programs to pay their construction workers the prevailing wage.

The legislation, which now heads to the governor, is intended to ensure that projects funded with state tax credits provide fair wages to their employees.

“When we award state tax credits to a project, we are making a public investment in it. Rhode Islanders expect state funds to be spent in a way that corresponds with our values, and one of those values has consistently been fair wages for workers. If we are supporting a construction project, it should pay its workers — our neighbors — a decent, fair wage,” said Representative Potter (D-Dist. 16, Cranston).

Said Senator Kallman (D-Dist. 15, Pawtucket, North Providence), “Job creation is among the purposes of our tax credits for development. The jobs we are helping to create are supporting Rhode Islanders and their families, and it’s in our state’s interest ensure that those jobs pay family-sustaining wages. With this bill, our state is helping to guarantee good wages to hardworking Rhode Islanders in the construction industry.”

The legislation (2022-H 7985A, 2022-S 2551B) applies only to projects valued at more than $10 million that benefit from the Rebuild Rhode Island or historic preservation tax credit programs. To ensure compliance, contractors and subcontractors on those projects would be required to file certified payrolls on a monthly basis with the Department of Labor and Training. Failure to comply with the requirements of the act would constitute a material breach of contract with the state.

The bill defines “construction worker” as any laborer, mechanic, or machine operator employed by a contractor or subcontractor in connection with the construction, alteration, repair, demolition, reconstruction, or other improvements to real property.




The man who died after trying to break into Cincinnati's FBI headquarters allegedly posted his intentions on his Truth Social account. Multiple outlets have identified the suspect as Ricky Shiffer, who allegedly pulled out an AR-15 style rifle before leading police on a chase that resulted in an hours-long standoff and ultimately led to his death. In recent days, an account appearing to belong to Shiffer posted that if no one hears from him it's because he tried attacking the FBI.        The House of Representatives is expected to pass the Senate-approved Inflation Reduction Act on Friday, sending the measure on to President Biden's desk. The bill is designed to fight climate change, extend health care coverage, and put hundreds of billions of dollars towards deficit reduction. House Speaker Nancy Pelosi has described it as "life-changing legislation." House Minority Leader Kevin McCarthy has pointed out that the bill would also increase the number of IRS agents, tweeting earlier this week that they "will be coming for you."        The death toll from flooding in Kentucky is now up to 39. That's according to a tweet from Governor Andy Beshear. He called it "more tough news." The news came after it was revealed today the commonwealth is finally out of the "emergency phase" of its flooding response.        The CDC says there are still unanswered questions about how monkeypox spreads. The agency is looking into whether the virus can spread through someone who's not showing symptoms. The agency also says they need to research more into if the virus can spread through bodily fluids and how often cases are being transmitted through coughing or sneezing. Infectious disease experts are acknowledging monkeypox can spread through surfaces.       A federal judge in Michigan is declaring a mistrial in a case related to the Flint water crisis. The trial against two private engineering companies, alleging they played a role in the crisis, ended with a hung jury. The eight-member jury handed a note to the judge saying they couldn't deliver a verdict without the single holdout juror "having to surrender their honest convictions       HBO is setting the release date for its upcoming documentary about the U.S. exit from Afghanistan. "Escape From Kabul" will be released on September 21st. The documentary was filmed over a period of 18 days during the American military withdrawal from Kabul International Airport last year.
